All services provided by Nurples Web Hosting may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, unlicensed software or files, or material protected by trade secret and other statue. The subscriber agrees to indemnify and hold harmless Nurples Web Hosting from any claims resulting from the use of the service which damages the subscriber or any other party.

Pornography - Due to legal and social issues, we will not accept any new customers who publish child pornographic images. We do not allow any child pornographic content on our server, including but not limited to photographs of nude children, explicit language, or sexual fiction. If an existing customer publishes child pornographic images, Nurples Web Hosting will suspend and cancel your account.

Let's make this easy to understand:
No site that promotes child porn or nudity will be allowed on our servers, this includes BANNERS, CLICKER SITES, EDITORIALS, STORIES, NUDE PHOTOGRAPHS OF CHILDREN, EXPLICIT LANGUAGE, SEXUAL FICTION, OR ANYTHING THAT NURPLES WEB HOSTING DEEMS INAPPROPRIATE FOR OUR SERVERS. If an existing customer publishes child pornographic images, Nurples Web Hosting will remove the site from our server without notice and all monies paid will be forfeited.

Examples of non-acceptable content, links and websites

• Pirated software
• "Illegal MP3's"
• Hacker and Cracker programs, Websites or archives
• Child Pornography
• Emails promoting child pornography

Warez Sites/Hacking Cracking Sites:
Warez Sites are sites that are typically used by "hackers" to trade (upload/download) illegally pirated copies of software programs with one another. Nurples Web Hosting has a zero-tolerance policy on all Warez Sites. Sites that become a trading post for "warez" programs will be reported to any and all regulatory, administrative, and/or governmental authorities for prosecution. In addition to your account being deleted from our servers, you may face legal action that can be taken against you by the programmers/software companies of the copyrighted software.

Nurples Web Hosting will be the sole arbiter as to what constitutes a violation of this provision.

Excessive CPU usage - Customers will not be allowed to use excessive amounts of CPU processing on any of our servers. Such action is grounds face immediate suspension. For example:

1) Personal Customers cannot give away have tried reselling our counters or auto-responders to the rest of the world which caused an excessive amount of requests on our server(s).
2) Email bombs.
3) Reselling CGI access to other 3rd parties
4) IRC Daemons, are strictly prohibited
5) Other activities, whether lawful or unlawful, that we determine to be harmful to our subscribers, operations, or reputation, including activities that restrict or inhibit any other user from using and enjoying the service or the Internet.
6) Spam, or Unsolicited Mail Submissions- NO DOMAIN MAINTAINED BY Nurples Web Hosting will be permitted to submit Spam or Unsolicited email of any type. The sending of Spam or unsolicited email using our email server.

HIGH RESOURCE USER POLICY
Resources are defined as bandwidth and/or processor utilization. Nurples Web Hosting may implement the following policy to its sole discretion:

When a website is found to be monopolizing the resources available, Nurples Web Hosting reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers.

If we receive a complaint on Spam or Unsolicited email from a Domain maintained on our servers, the account will be subject to suspension and/or cancellation without notice.

To maintain the integrity of our service the following limitations apply:

Sites running large chat room gatherings.

Nurples Web Hosting will be the sole arbiter as to what constitutes a violation of this provision.

Chat Rooms:
Nurples Web Hosting does allow clients to install chat rooms, these can be found in the control panel. However, these tend to be large system hogs and may fall into the usage limitations policy (see above). We do not allow the installation of your own chatroom scripts.

Background Processes/Programs
Nurples Web Hosting may allow programs to run continually in the background, these are considered on a one to one basis and a extra charge may be incured based on system resources used and operational maintenance needed.

Cron Jobs:
Nurples Web Hosting does allow Cron Jobs to be conducted on our servers.

IRC:
Nurples Web Hosting currently does not allow IRC, IRC bots, and psyBNC to be operated on our servers.

Commercial Advertising - Email:
Spamming, or the sending of unsolicited email, from a Nurples Web Hosting server or using an email address that is maintained on a Nurples Web Hosting machine is STRICTLY prohibited. For general reference, we consider spam any email that is sent to more than 10 people at a time that did not ask for it to be sent to them.

Nurples Web Hosting will be the sole arbiter as to what constitutes a violation of this provision.

Opt-In email is acceptable, as long as Opt-Out/Removal request are fully honored. Nurples Web Hosting has allocated tools to ensure proper delivery of opt-in opt-out mailing lists and normal email. It is important that you use these tools accordingly. All full packages include access to the pre-installed Mailman Mailing List Software. Large mailing lists, (those exceeding 500 subscribers) sent using the Nurples Web Hosting Services, must be sent using the mailing list tools that have been pre-installed for this purpose. If your mailing list exceeds 1,500 addresses you should contact Nurples Web Hosting requesting permission to send the mailing through the Nurples Web Hosting servers prior to sending any messages. Sending a large mailing through mailing list software other than Nurples Web Hosting's pre-installed software can adversely affect the flow of email. Should such a large mailing disrupt normal services or create unacceptable server loads, the account associated with the mailing risks termination. All accounts may only have one mailing list. Running more than one mailing list on your account risks suspension and termination of services.

Please make an effort to send out large mailings from the hours of 12AM - 8AM EST.

Server Abuse:
Any attempts to undermine or cause harm to a Nurples Web Hosting server or customer of Nurples Web Hosting is strictly prohibited. Nurples Web Hosting will pursue legal action to the fullest extent for all abuse of the Nurples Web Hosting Network.

Suspension/De-Activation:
If any terms or conditions are failed to be followed it will result in grounds for account suspension or de-activation. Nurples Web Hosting reserves the right to remove any account without prior notice. If Nurples Web Hosting deactivates your account(s) for violating policy, your will forfeit your rights to a refund...and none will be given. No refunds for advance payments, on de-activated accounts. Normal policy is a warning first, and account de-activation the second offense. Serious offenses may cause immediate de-activation.

Use of Nurples Web Hosting Service constitutes acceptance and agreement to Nurples Web Hosting's AUP as well as Nurples Web Hostings TOS (Terms of Service)

Nurples Web Hostings reserves the right to revise, amend, or modify this AUP, our TOS (Terms of Service) and our other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be posted in accordance with our TOS (Terms of Service). All users of Nurples Web Hostings Internet services, and their clients, must comply with this AUP and our TOS (Terms of Service).
